The following terms and conditions apply to any agreement made between Kigezi Harambe Tours and Travels and you (referring to all individuals named in a booking). These terms are important, so please take a moment to review them.

Booking your travel with us signifies that you have read, understood, and agreed to the terms and conditions outlined below.

  1. BOOKING AND PAYMENT

1.1 All services are subject to availability and are not guaranteed until confirmed.

1.2 A non-refundable deposit of 20% (or a higher deposit if required for the specific tour) of the total amount per person listed on the booking form is required at the time of booking. Any higher deposit for a particular tour will be indicated prior to confirmation.

1.3 If gorilla permits are necessary, they must be fully paid at the time of confirmation and are non-refundable. This is in addition to the standard non-refundable deposit.

1.4 The remaining balance must be paid 30 days before the tour begins, unless stated otherwise. Failure to make this payment will result in the booking being treated as canceled, subject to the normal cancellation policy.

1.5 For bookings made within 30 days of the tour’s start date, full payment is required at the time of booking. The agreement between us is finalized when your confirmation invoice is issued.

1.6 At the time of booking, we require full details for all passengers (names as they appear on passports).

  1. PRICES

2.1 All prices are quoted in United States Dollars (US$), unless otherwise specified.

2.2 Prices quoted by Kigezi Harambe Tours and Travels are subject to change without notice and are not guaranteed until confirmation.

2.3 The quoted prices are per person and based on the itinerary provided. Unless stated otherwise, the following are included: overnight accommodation as specified, national park and game reserve entrance fees, boat cruises, overland transportation, domestic air travel where indicated, drivers and guides, chimpanzee tracking permits, and three meals per day as indicated.

2.4 The quoted prices do not include personal expenses, personal insurance, laundry, meals not stated, drinks, passport and visa fees, tips and gratuities, or international flights.

2.5 Meals are provided three times a day: breakfast, lunch, and dinner, with a packed lunch or picnic included for one of these meals.

2.6 Accommodation types vary depending on location and pricing plan, including camping, tented camps, Bandas, guesthouses, rented accommodations, and hotels.

2.7 Kigezi Harambe Tours and Travels reserves the right to substitute accommodation if necessary.

2.8 If a client wishes to upgrade their accommodation during the tour, an additional fee will be required. Upgrades are subject to availability and are not guaranteed.

  1. DESCRIPTIONS AND SERVICE

3.1 All descriptions and information (including details on accommodation and activities) are based on the most current information available and are provided in good faith. Kigezi Harambe Tours and Travels is not liable for any deviations from these descriptions.

3.2 Transport provided will depend on the itinerary and the number of participants. While we strive to ensure vehicles are well-maintained and roadworthy, we do not accept liability for breakdowns, punctures, road conditions, or any delays that result from such issues.

3.3 We reserve the right to utilize subcontracted services where necessary.

3.4 We cannot guarantee sightings of wildlife, including chimpanzees and gorillas, as they are wild animals.

  1. COMPLAINTS

4.1 If you are dissatisfied with any service or facility, you must inform your guide, tour leader, or driver from Kigezi Harambe Tours and Travels immediately, and allow them the opportunity to resolve the issue promptly.

4.2 If the issue is not resolved to your satisfaction after informing the representative, you may submit a formal complaint in writing to Kigezi Harambe Tours and Travels within 28 days of the tour’s completion. We will not accept any liability for complaints not notified in this manner.

  1. CANCELLATION & REFUNDS

5.1 Cancellation by you:

5.1.1 If you choose to cancel your holiday, you must notify us as soon as possible. Any cancellation made by phone must also be confirmed in writing or by email within 24 hours, and will be effective from the day we are notified, provided written confirmation is received within 24 hours of the initial notification.

5.1.2 Cancellation charges are based on the tour price and are applied as follows:

  • More than 60 days prior to the tour start date: loss of deposit.
  • 30-60 days prior to the tour start date: loss of 50% of the total cost.
  • 15-29 days prior to the tour start date: loss of 75% of the total cost.
  • Less than 15 days prior to the tour start date: loss of 100% of the total cost.

We highly recommend purchasing insurance that covers cancellations and refunds.
5.1.3 No refunds will be provided for gorilla permits regardless of the cancellation date.

5.1.4 No refunds will be given for unused services, late arrivals, or absent clients.

5.1.5 We accept no liability for any loss or damage arising from cancellations.

5.2 Cancellation by Kigezi Harambe Tours and Travels:

5.2.1 We reserve the right to cancel your holiday and charge cancellation fees (as stated above) if you fail to pay the balance on time or behave in an inappropriate manner (as defined below).

5.2.2 Kigezi Harambe Tours and Travels reserves the right to cancel your tour up to 60 days before the start date. After this period, cancellations will only occur for reasons beyond our control. In such cases, we will offer you either an alternative tour (if available) or a full refund. If we cancel your tour, we will offer one of the following options:

  • A similar arrangement of the same standard and price, if available.
  • A lower standard arrangement, with the price difference refunded.
  • A more expensive arrangement, where you will pay the price difference.
  • A full refund.

5.2.3 Kigezi Harambe Tours and Travels accepts no liability for any loss or damage resulting from cancellations.

  1. ALTERATIONS

6.1 Alterations by you:

6.1.1 If you wish to alter your confirmed booking, we will try our best to accommodate the changes, but it may not always be possible. A minimum fee of US$50 applies for alterations, plus any additional costs due to the change, subject to availability.

6.2 Alterations by Kigezi Harambe Tours and Travels:

6.2.1 We reserve the right to alter confirmed bookings. While rare, such changes may be necessary. Given the nature of the tours, itineraries and arrangements may need to be flexible, and we will notify you of any changes as soon as possible.

6.2.2 Alterations may be significant or minor. Significant alterations may include price increases of over 10%, changes to the destination, or a downgrade in accommodation. Minor changes may occur at any time, and we will strive to inform you of such alterations before departure.

6.2.3 For significant alterations, we will notify you promptly and offer the following four options:

  1. a) A similar arrangement of the same nature, standard, and price, if available.
  2. b) A lower standard arrangement with a refund of the price difference.
  3. c) A more expensive arrangement, with you covering the price difference.
  4. d) A full refund.

6.3 Alterations by third parties:

6.3.1 Kigezi Harambe Tours and Travels has no direct control over third-party suppliers. In cases where the supplier makes significant changes, we will attempt to inform you promptly, but we accept no responsibility for such changes.

6.4 Alterations due to circumstances beyond our control:

6.4.1 In situations outside our control, such as road closures, extreme weather, issues with national parks, strikes, or other unexpected situations, we may need to alter the itinerary, change accommodations, or modify transport arrangements. We will inform you as soon as possible and make reasonable efforts to resolve the situation. However, we will not be liable for any costs resulting from such alterations.

  1. LIMITATION OF LIABILITY

7.1 Kigezi Harambe Tours and Travels will not be liable for any loss, injury, or damage caused by events or situations beyond our control, such as natural disasters, political unrest, strikes, or terrorist activity.

7.2 We are also not liable for personal injury, loss, damage, or illness caused by third-party suppliers or the actions of other guests during the tour.

7.3 We will take reasonable care to provide the services agreed upon, but we will not be responsible for any losses or damages unless caused by our direct negligence or breach of contract.

  1. INSURANCE

8.1 It is mandatory that you have comprehensive travel insurance that covers personal accidents, medical expenses, emergency evacuation, cancellation, and loss of luggage.

8.2 Kigezi Harambe Tours and Travels reserves the right to request proof of insurance.

  1. HEALTH REQUIREMENTS

9.1 You are required to ensure that you are fit to travel. Kigezi Harambe Tours and Travels reserves the right to refuse your participation in the tour if you are deemed unfit for travel.

9.2 It is your responsibility to inform Kigezi Harambe Tours and Travels of any pre-existing medical conditions or physical limitations before booking.

  1. GOVERNING LAW

10.1 These terms and conditions are governed by the laws of Uganda, and any disputes arising from them will be subject to the jurisdiction of the courts in Uganda.
